Ibadan customary court dissolves seven year old marriage after wife denies husband sex for two and a half years

MAPO Customary Court in Ibadan has granted a local man named Wahab Olabanmiji a dissolution of his seven year old marriage after he revealed that he had been sex starved by his wife who denied him conjugal rights.

 

Mr Olabanmiji had approached the court seeking the dissolution of the marriage because his wife, Tawakalitu, denied him of sex. According to the petitioner who lives at Olopo-Meta Estate, Ibadan, his wife was also endangering his life with her extra-marital relationships, pointing out that for two-and-half years now, she had been having sex with other men and not him.

 

He added: “Tawakalitu has remained a source of frustration to me for two-and-a half years now, denying me of sex. All my efforts at changing her attitude for good have yielded no result as she has become a pain in my neck.

 

“In addition, Tawakalitu is heavily involved in adulterous acts and I have caught her many times. Worst still, she has been having grudges with my children from my first wife, as she doesn’t want to see them as she has not hidden her hatred for them."

 

In her response, Tawakalitu agreed to the divorce and did not deny the allegation of sexual starvation levelled against her. She, however, said that she denied her husband sex because she was acting on a medical advice.

 

Tawakalitu added: “My lord, a nurse told me that I could contract diseases by continually allowing Wahab to sleep with me since he also sleeps with an old woman who is already in her menopause. The nurse said that the only option I had was to stop sleeping with Wahab and for two-and-a half years now, no man has touched me.”

 

After listening to both sides, court president Ademola Odunade, dissolved the seven-year-old marriage, adding that he took the decision because the estranged couple were resolute in their decision to part ways. Mr Odunade granted custody of the two children produced by the union to Tawakalitu and ordered Wahab to pay a monthly allowance of N6,000 for the children’s upkeep.

 

While delivering his ruling, Mr Odunade  advised housewives to maintain their vows of fidelity because it was vital to trust in any marriage. Following his ruling, the couple are now free to go their separate ways.
